Terms of use

These terms govern access to and use of the MedixCart marketplace (the Platform), operated by MedixCart FZC LLC, a company registered in the United Arab Emirates (MedixCart, we). By creating an account or placing an order you agree to these terms on behalf of the organisation you represent.

1. Who may use the Platform

• The Platform is for business use only by licensed healthcare facilities, laboratories, pharmacies, distributors and suppliers. It is not intended for consumers.
• You must provide accurate organisation details and valid licences, and keep them current. We may suspend accounts whose licences expire or cannot be verified.
• You are responsible for the users you invite to your organisation and the roles and spending limits you assign them.

2. Role of MedixCart

For products sold by third-party sellers, MedixCart operates the marketplace and is not the seller. The contract of sale is between the buyer and the seller named on the product page and invoice. For our exclusive brands (AUG Medical and Clove Dental), MedixCart or its affiliate is the seller and importer of record.

3. Listings, certification and restricted products

• Sellers are responsible for the accuracy of listings, certificates, registration numbers and instructions for use. MedixCart reviews documents before listing but does not warrant the clinical suitability of any product.
• Restricted products may only be purchased by facilities cleared by MedixCart compliance.
• Buyers remain responsible for using devices in accordance with the instructions for use and applicable health authority requirements.

4. Quotations and orders

• Quotations are valid until the date stated by the seller. Accepting a quotation creates an order on the quoted terms.
• Prices are shown in AED excluding 5% UAE VAT unless stated. VAT is added at checkout and shown on the tax invoice.
• Orders above a requester's spending limit require approval within the buyer organisation before payment.

5. Payment and escrow

Payments are collected by MedixCart through Wio Bank payment links, card or bank transfer and held until delivery is confirmed or the confirmation period ends, after which the seller is paid net of the agreed commission (2% for third-party sellers). Credit terms, where offered, are subject to separate approval.

6. Delivery, returns and recalls

• Sellers ship to the delivery address selected at checkout and record batch, lot and expiry details where applicable.
• Return requests must be raised through the Platform. Returns of sterile, opened or cold-chain products may be refused unless defective.
• Buyers agree to cooperate with product recalls and field safety notices communicated through the Platform.

7. Acceptable use

You may not misuse the Platform, list or purchase counterfeit, unregistered or prohibited products, circumvent the Platform to avoid commission on introduced transactions, or access data belonging to other organisations.

8. Liability

To the extent permitted by UAE law, MedixCart is not liable for indirect or consequential losses, and its total liability relating to an order is limited to the fees it received for that order. Nothing limits liability that cannot be limited by law.

9. Governing law

These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Disputes are subject to the exclusive jurisdiction of the Dubai courts, unless otherwise agreed in writing.
